Purpose and Scope of this Policy

This privacy policy (“Privacy Policy”) describes how ChatterHigh Communications Inc. and its affiliates (collectively, “CHATTERHIGH”) treat the personally identifiable information that is collected about you when you use of any data, educational materials, information, software, graphics, images, and other materials that CHATTERHIGH may make available to you and/or any services CHATTERHIGH may provide through CHATTERHIGH’s website, CHATTERHIGH’s mobile applications, or other electronic means (collectively, the “Services”).

Collection of Information

Information You Provide. CHATTERHIGH generally collects Personally Identifiable Information that you voluntarily provide. For instance, when you sign-up, enter a contest, complete a survey, participate in a reader panel, participate in our social networking features, subscribe to receive newsletters, or other electronic services, or send us an email or feedback, you may be asked to provide information such as your e-mail address, first name, shipping address, and billing information, and we will collect such information as well as any other content you provide us in engaging in any of the above activities. Information such as your age, gender, or interests may also be requested. If you elect to post material to any blogs, forums, participate in our social networking features or other community boards that may be offered on our Covered Sites, then such materials will be collected and may be publicly available for others to view.

For the purposes of this Privacy Policy, “Personally Identifiable Information” is information that CHATTERHIGH can use to identify or contact you as an individual, and includes your first name, last name, initials, email address, gender, school, state/province, country, program, language, contact information, and any other information that CHATTERHIGH associate with any of the foregoing. By submitting Personally Identifiable Information through any of the Services, you agree to the terms of this Privacy Policy and you expressly consent to the collection, use, and disclosure of your Personally Identifiable Information in accordance with this Privacy Policy. This Privacy Policy does not apply to information collected about you by anyone except CHATTERHIGH.

In addition to the provisions of this Privacy Policy, your use of the Services is governed by CHATTERHIGH’s terms of service (the “Terms of Services”), a copy of which can be viewed at http://chatterhigh.com/en/tos

Collection of Information

Information such as your age, gender, or interests may also be requested. If you elect to post material to any blogs or forums, or participate in our social networking features or other community boards that may be offered on the Services, then such materials will be collected and may be publicly available for others to view.

Cookies

CHATTERHIGH may set and access cookies and similar technologies on your computer. A cookie is a small amount of data (often including a unique identifier) is sent to your browser from a web site’s computers and stored on your computer’s hard drive. Some cookies may be local shared objects, also known as Flash cookies. Cookies may be session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them). CHATTERHIGH uses cookies to understand site usage and to improve the content and offerings on our Services and in other media. CHATTERHIGH may use cookies to track usage patterns on the sites, to deliver editorial content, to record requests for subscriptions and to personalize information. Our cookies may contain Personally Identifiable Information and such cookies may be shared with others. CHATTERHIGH may also use cookies to collect aggregate information about web site users on an anonymous basis (“Anonymous Information”). CHATTERHIGH may share aggregate demographic and usage information with our prospective and actual business partners, advertisers and other third parties for any business purpose.

If you don’t want cookies, most web browsers include an option that allows you to not accept them. However, if you set your browser to refuse cookies, some portions of our Services may not function efficiently.

Use of Information

CHATTERHIGH uses information we collect from you in part to provide you with the service you have requested. Similarly, if you enter online draws / competitions, we will also use this information to notify you if you are a winner. We also use information to register you, identify you as a user, improve our Covered Sites and services, send you administrative notifications, and respond to your inquiries. We might also send out e-mails to users and contest entrants to announce special offers, services and announcements from our Covered Sites, our partners. We also use information to serve other content as described below. We may combine and use any and all information we collect on you online for marketing purposes. In addition, we may use information you provide us through emails, Q&A, blogs, forums, in response to polls, or through any other user generated submission for editorial purposes, and may use your name and any stories you provide us in articles published online. If you provide us with personal anecdotes, they may be attributed to you. CHATTERHIGH can edit, rewrite, use, and reuse the content, including your name, likeness, photograph, and biographical information you provide, with or without attribution, including publication in trade media. We may create Anonymous Information from Personally Identifiable Information by excluding information (such as your name) that make the data personally identifiable to you. We use this Anonymous Information for any purpose and disclose Anonymous Information to third parties in our sole discretion.

Disclosure of Your Information

In addition to the other disclosures described in this policy, CHATTERHIGH may (and you authorize CHATTERHIGH to) share or disclose Personally Identifiable Information about you to other companies or individuals in the following situations:

  • With other users of the Services in order to provide the Services, such as disclosing a child’s information with a parent, teacher, or school administrator so that the parent, teacher, or school administrator can monitor the student’s progress on our Services;
  • To non-affiliated companies that CHATTERHIGH engages as contractors or agents to perform services for CHATTERHIGH, such as administering the website, systems, and software; sending direct mail communications; or administering a contest. CHATTERHIGH will disclose your information with such contractors only to the extent reasonably necessary for them to perform services on our behalf, consistent with this Privacy Policy;
  • If you register for a CHATTERHIGH webinar or event, CHATTERHIGH may use your contact information to send you notifications relevant to the webinar or event;
  • In response to subpoenas, court orders, or legal process, from law enforcement agencies or provincial, state, and federal regulators, or as otherwise required by law;
  • To assert or defend CHATTERHIGH’s legal rights, including fraud prevention and enforcing this Privacy Policy and our Terms of Service;
  • To protect the rights, property, or safety of CHATTERHIGH or other persons, including to detect, prevent, or otherwise address fraud, security, or technical issues, or anything else that CHATTERHIGH may consider to be, or pose a risk of being, an illegal, unethical, or legally actionable activity;
  • As CHATTERHIGH deems appropriate to attempt to prevent physical or emotional harm to other persons and/or to their property based on overt or implied threat;
  • In connection with an actual or proposed corporate merger, acquisition, asset purchase, or other transaction or proceeding involving all or part of the business or assets to which the information pertains;
  • To analyze how users interact with the Services; to monitor and analyze usage and activity trends; and for other research, analytical, and statistical purposes; and
  • To other companies, such as direct marketers to perform marketing services on CHATTERHIGH’s behalf, or other institutions with whom CHATTERHIGH has joint marketing agreements.
  • You hereby acknowledge and agree that you have furnished CHATTERHIGH Personally Identifiable Information with the intent that it be forwarded to a third party for use in connection with a specified Service you are electing to participate in.

    CHATTERHIGH must comply with applicable laws, regulations, and legal or regulatory process, and comply with subpoenas or warrants served on CHATTERHIGH or in connection with a legal investigation; or CHATTERHIGH have reason to believe that someone may be causing injury to someone or interfering with our rights or the rights of our users, or general public, or using our services in violation of a legal or personal right, including our Terms of Service (collectively, the “Legal Exceptions”).

    Social Networks

    If you use your login credentials from a social networking site (“SNS”) in connection with the Services, CHATTERHIGH may receive information from such SNS in accordance with the terms and conditions of the SNS (“SNS Terms”). If you elect to share your information with these SNS, CHATTERHIGH will share information with them in accordance with your election. The SNS Terms of these SNS will apply to the information CHATTERHIGH disclose to them.

    Right to Opt-Out

    You have the option upon signing up or at any time in your account settings of opting in for promotional materials on behalf of CHATTERHIGH. If you want CHATTERHIGH to stop sending you promotional materials to your email, you may follow the unsubscribe instructions in the email or email CHATTERHIGH at info@chatterhigh.com.

    If you have opted-out as described above, and thereafter you elect to use a Service or promotion that requires CHATTERHIGH to contact you or share your information with a third party (e.g., you enter into a contest or use an ecommerce service after opting-out), then your previous opt-out preferences will not apply to such service. Despite your indicated preferences, CHATTERHIGH may send you service related communications, including notices about your subscription, and CHATTERHIGH may continue disclosing your information to third parties under the exceptions set forth in this Privacy Policy.

    You may access, modify, or delete the personal information that you have provided to us by logging into your ‘My Account’ page found in the dropdown under your name on the dashboard: http://chatterhigh.com/en/home or emailing us at info@chatterhigh.com. If you request restrictions on CHATTERHIGH’s uses or disclosures of your personal information, CHATTERHIGH may comply with your request by terminating your membership and deleting your account information. Please note that CHATTERHIGH can only honour requests to out opt of disclosures on a going forward basis and opt-out requests do not affect information that CHATTERHIGH has previously disclosed. CHATTERHIGH may also retain certain information about you as required by law or as permitted by law for legitimate business purposes. For example, if you request that CHATTERHIGH delete your information but CHATTERHIGH believes that you have violated our Terms of Service, CHATTERHIGH may retain information about you in order to attempt to resolve the issue before deleting it.

    Links to Third-Party Sites

    CHATTERHIGH may provide links from the Services or Materials to third-party websites, applications, or other platforms (collectively, “Third-Party Sites”). If you use these links, you will leave the Services. CHATTERHIGH is not obligated to review any Third-Party Sites linked to from the Services, CHATTERHIGH does not control any of the Third-Party Sites, and CHATTERHIGH is not responsible for any of the Third-Party Sites (or the products, services, or content available through any of them).

    This Privacy Policy will not apply to your independent relationships with other companies that from time to time may offer you products and services, or are otherwise linked from on our Services. Those companies’ privacy policies will govern how they collect, use, and disclose personal information that you provide to them.

    CHATTERHIGH does not endorse or make any representations about such Third-Party Sites, any information, software, products, services, or materials found there or any results that may be obtained from using them. If you decide to access any of the Third-Party Sites linked to from the Services, you do this entirely at your own risk and you must follow the privacy policies and terms and conditions for those Third-Party Sites. Certain areas of the Services may allow you to interact and/or conduct transactions with one or more Third-Party Sites or services, and, if applicable, allow you to configure your privacy settings in that third-party account to permit your activities on the Services to be shared with your contacts in your third-party site account.

    Tracking by Third Parties

    Our third party partners include a wide variety of companies, who may display targeted advertisements. Although CHATTERHIGH does not provide any personal information to the advertiser or advertising vendor, by interacting with or clicking on an ad you consent to the possibility that the advertiser will assume you meet the criteria used to target the ad.

    In addition to cookies placed by CHATTERHIGH or its agents, as described above, advertisers and advertising vendors that serve ads onto the Services or other services may use their own cookies or other tracking technologies. CHATTERHIGH is not responsible for the privacy policies or practices of any such advertisers and vendors.

    CHATTERHIGH uses third-party online business optimization software to assist in the capture and analysis of customer usage information. These service providers act as limited agents to CHATTERHIGH, for the purpose of providing their services. Any information obtained by such third parties from our users or CHATTERHIGH is and will remain our property, and will be subject to this Privacy Policy. CHATTERHIGH does not permit these service providers to review, share, distribute, print, or reference any session data of visitors to the Services, except as specified in our agreements with them or as may be required by law.

    Security

    CHATTERHIGH uses a variety of industry-standard security technologies and procedures to help protect your Personally Identifiable Information from unauthorized access, use, or disclosure. No method of transmission over the internet, or method of electronic storage, is 100% secure, however. Therefore, while CHATTERHIGH uses reasonable efforts to protect your Personally Identifiable Information, CHATTERHIGH cannot guarantee its absolute security.

    You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. CHATTERHIGH is not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

    If you are a parent, teacher, or school administrator, CHATTERHIGH encourages you to talk to your children or students about online safety and how they can protect themselves online.

    Non-Canadian Users

    If you are located outside of Canada, please note that the information you provide to CHATTERHIGH may be transferred to, processed in, and stored in Canada, where laws regarding processing of your Personally Identifiable Information may be less stringent than the laws in your country. By using the Services, you consent to this transfer, processing and storage. You also consent to the adjudication of any disputes arising in connection with the Services as provided by our Terms of Service.

    Changes to the Privacy Policy

    CHATTERHIGH will occasionally update this Privacy Policy as necessary to protect our users and to comply with applicable laws and best practices employed by other publishers and regulatory organizations across the industry. CHATTERHIGH recommends that you check the Privacy Policy each time that you use the Services to be sure that you are aware of and understand our current Privacy Policy. CHATTERHIGH shall inform you of any modifications to this Privacy Policy by posting such modifications on its website and, if you have registered for an account with CHATTERHIGH, by describing the modifications to this Privacy Policy in an email that CHATTERHIGH will send to the address that you provided during registration. To be sure CHATTERHIGH properly reach your email inbox, CHATTERHIGH just ask that you let CHATTERHIGH know if your preferred email address changes at any time after your registration. CHATTERHIGH will not make any retroactive material changes in how CHATTERHIGH handles previously collected Personally Identifiable Information unless you allow CHATTERHIGH to do so, or unless CHATTERHIGH is legally required to do so.

    If you object to any such modifications of the Privacy Policy, you must cease all use of the Services. Continued use of any Services following notice of any such modifications indicates you acknowledge and agree to be bound by the modifications.
